However, the provisions concerning product returns and the right of withdrawal set out in these Terms and Conditions do not apply to legal entities. Legal entities may return goods only on the general grounds provided for under Lithuanian law.<\/span><\/p>\n<p class=\"translation-block\"><span style=\"font-family: georgia, palatino;font-size: 14px\">By accepting these Terms and Conditions, the Customer confirms that they are legally entitled to purchase goods from the online store at <a href=\"https:\/\/www.spianato.lt\/en\/\" target=\"_self\">www.spianato.lt<\/a>.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">Before using www.spianato.lt, we recommend that you familiarise yourself with our Terms and Conditions, Privacy Policy and Delivery Information.<\/span><\/p><p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><br><\/span><\/p>\n<p><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><strong>Conclusion of the Sales Contract<\/strong><\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">The sales contract between the Customer and the Seller shall be deemed concluded when the Customer has selected the product(s) they wish to purchase, added them to the shopping basket (hereinafter referred to as the \u201cShopping Basket\u201d) and clicked the \u201cProceed to Checkout\u201d button.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">Once the Sales Contract has been concluded, the products selected by the Customer, their quantities, prices, delivery times and any other conditions specified during the ordering process shall be binding on both the Customer and the Seller.\n\nThese terms may only be amended in accordance with the procedures set out in these Terms and Conditions.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">Sales contracts are recorded and stored in the Seller\u2019s database.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><br><\/span><\/p>\n<p><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><strong>Customer Rights and Obligations<\/strong><\/span><strong style=\"font-family: georgia, palatino; font-size: 14px;\"><em>&nbsp;<\/em><\/strong><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">The Customer has the right to purchase goods from the online store at www.spianato.lt in accordance with these Terms and Conditions.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">By placing an order, the Customer is obliged to accept delivery of the goods in accordance with the procedures set out in these Terms and Conditions, refrain from abusing their rights as a customer, and comply with applicable laws and regulations.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">If the Customer refuses to accept delivery of the goods without a valid reason, the Customer shall, at the Seller\u2019s request, reimburse the costs incurred in returning the goods to the Seller, where permitted by applicable law.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><br><\/span><\/p>\n<p><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><strong>Seller\u2019s Rights and Obligations<\/strong><\/span><\/p>\n<p><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">The Seller undertakes to provide Customers with the opportunity to order goods through www.spianato.lt in accordance with the procedures set out in these Terms and Conditions.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">The Seller undertakes to deliver the goods purchased by the Customer using the delivery method selected and to the address provided by the Customer when placing the order.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">The Seller undertakes to respect the Customer\u2019s privacy and process their personal data in accordance with the requirements of applicable data protection laws and regulations.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">The Seller undertakes to make every reasonable effort to fulfil the Customer\u2019s order. However, in exceptional circumstances beyond the Seller\u2019s control, it may not be possible to deliver an item purchased by the Customer.\n\nIn such cases, where the Sales Contract cannot be fulfilled, the Seller reserves the right to terminate the contract, having first informed the Customer.\n\nIn an effort to meet the Customer\u2019s needs, the Seller may offer an alternative product similar to the one originally ordered or purchased.\n\nIf the Customer declines the alternative, the Seller undertakes to refund the full amount paid by the Customer within 5 working days.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><strong>&nbsp;<\/strong><\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><strong>Product Prices and Order Payments<\/strong><\/span><\/p>\n<p><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">All product prices displayed in the online store at www.spianato.lt and in the order summary are stated in euros (EUR).\n\nThe Seller is VAT-registered, and all product prices displayed on www.spianato.lt are inclusive of VAT.\n\nAny applicable delivery charges will be added to the total order amount before the Customer confirms their purchase.<\/span><\/p>\n<p class=\"translation-block\"><span style=\"font-family: georgia, palatino;font-size: 14px\">Payment Methods and Terms.<strong><br><\/strong>The Customer may pay for purchased goods using one of the following methods:<\/span><br><span style=\"font-family: georgia, palatino;font-size: 14px\">Online banking or Paysera.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">When paying by online banking, the Customer undertakes to complete the payment immediately.\n\nThe order will only be prepared for dispatch once payment has been received.\n\nIf payment is not completed within 2 hours, the order will be automatically cancelled and removed from the system.<\/span><\/p>\n<p><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><strong>&nbsp;<\/strong><\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><strong>Authenticity<\/strong><\/span><\/p>\n<p><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">SPIANATO is an official retailer of certified, premium-quality natural cosmetics and personal care brands. All products are guaranteed to be authentic and are sourced directly from the manufacturers or their authorised distributors, often through special orders.<\/span><\/p>\n<p><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><strong>&nbsp;<\/strong><\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><strong>Preki\u0173 pristatymas<\/strong><\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">The Customer who selects the delivery service undertakes to provide an accurate delivery address.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">The Customer undertakes to accept delivery of the goods personally. If the Customer is unable to receive the goods in person and they are delivered to the address specified by the Customer using the delivery details provided, the Customer shall not be entitled to make a claim against the Seller solely on the grounds that the goods were received by another person;<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">Delivery charges may vary depending on the rates offered by our delivery partners at the time. However, the Customer will always be informed of any changes to delivery charges before placing an order.<\/span><\/p>\n<p><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">The delivery charge applies per order.<\/span><br><span style=\"font-family: georgia, palatino; font-size: 14px;\">The Customer will be shown the exact delivery charge before confirming their order. Once the order has been confirmed, the delivery charge will remain unchanged.<\/span><\/p>\n<p class=\"translation-block\"><span style=\"font-family: georgia, palatino;font-size: 14px\">The Seller undertakes to deliver the purchased goods as promptly as possible, and in any event no later than the delivery period specified by the Seller.<\/span><br><span style=\"font-family: georgia, palatino;font-size: 14px\">The Seller shall not be held liable for delays or failure to deliver goods where such circumstances arise due to the Customer's actions or other circumstances attributable to the Customer.<\/span><br><span style=\"font-family: georgia, palatino;font-size: 14px\">Upon receiving the goods, the Customer must inspect the condition of the parcel, including any visible damage to the outer packaging, together with the Seller or their authorised representative, and sign the invoice, delivery note or other proof of delivery and acceptance. By signing such a document, the Customer acknowledges that the parcel has been received in an apparently satisfactory condition.<\/span><br><span style=\"font-family: georgia, palatino;font-size: 14px\">If the Customer notices any damage to the parcel's packaging, they must record this on the invoice, delivery note or other proof of delivery and acceptance, and either prepare a written damage report in the presence of the Seller or their authorised representative, or immediately contact the Seller using the contact details provided. If the Customer fails to take these steps, the Seller shall not be held liable for damage to the goods that is not attributable to a manufacturing defect, or for discrepancies in the contents of the parcel that could have been identified through an external inspection.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">The characteristics of all products offered for sale are detailed in their individual product descriptions.\n\nThe Seller cannot guarantee that the colours, shapes, sizes or other characteristics of products displayed on the online store at www.spianato.lt will appear exactly as they do in reality, as their appearance may vary depending on the settings and characteristics of the Customer\u2019s screen.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><br><\/span><\/p>\n<p><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><strong>Returns<\/strong><\/span><\/p>\n<p><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">Non-defective cosmetic products cannot be exchanged or returned. If you receive a defective product, please contact us:<\/span><\/p>\n<p class=\"translation-block\"><span style=\"font-family: georgia, palatino;font-size: 14px\">by email at <a href=\"mailto:info@spianato.lt\" target=\"_self\">info@spianato.lt<\/a> or by telephone on +370 636 03449.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">As an exception, a non-defective product purchased from www.spianato.lt may be exchanged for another item, provided that the Customer contacts the Seller directly on the day of purchase or the following day.\n\nThe Customer may return unsuitable products within 14 days of delivery and receive a refund. Returned products must be unused and in their original saleable condition.&nbsp;<\/span><\/p>\n<p class=\"translation-block\"><span style=\"font-family: georgia, palatino;font-size: 14px\">The following conditions apply to the exchange of non-defective goods under the exceptional exchange policy:<\/span><br><span style=\"font-family: georgia, palatino;font-size: 14px\">\u2022 The product packaging must be intact and undamaged;<\/span><br><span style=\"font-family: georgia, palatino;font-size: 14px\">\u2022 Products may only be exchanged for items of equal or higher value;<\/span><br><span style=\"font-family: georgia, palatino;font-size: 14px\">\u2022 This policy allows exchanges only. However, the Customer will always be informed of any changes to return shipping costs before placing a return request.<\/span><\/p>\n<p><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><strong>The following conditions must be met when returning goods:<\/strong><\/span><\/p>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\"><em>&nbsp;<\/em><\/span><\/p>\n<ul>\n<li class=\"translation-block\"><span style=\"font-family: georgia, palatino;font-size: 14px\">Returned goods must be in their original, undamaged packaging, unused, free from damage and in their original saleable condition;<\/span><br><span style=\"font-family: georgia, palatino;font-size: 14px\">\u2022 Non-defective goods must be returned complete with all items originally supplied, including any complimentary gifts, miniature products and samples received with the purchase;<\/span><br><span style=\"font-family: georgia, palatino;font-size: 14px\">\u2022 When returning non-defective goods, the Customer is responsible for the return shipping costs, which will be deducted from the refund amount. Non-defective goods may be returned using one of the return methods specified by the Seller in these Terms and Conditions within 14 (fourteen) days of receipt. This provision does not apply to defective goods, which may be returned in accordance with the applicable statutory guarantee period.<\/span><\/li>\n<li class=\"translation-block\"><span style=\"font-family: georgia, palatino;font-size: 14px\">When the Customer returns non-defective goods, the return shipping costs will be deducted from the refund issued by the Seller.<\/span><br><span style=\"font-family: georgia, palatino;font-size: 14px\">\u2022 If defective goods are returned, the Customer will not incur any return shipping costs, as these will be covered by the Seller.<\/span><br><span style=\"font-family: georgia, palatino;font-size: 14px\">\u2022 Returns and exchanges of goods of satisfactory quality are carried out in accordance with Article 6.228<sup>10<\/sup> of the Civil Code of the Republic of Lithuania;<\/span><br><span style=\"font-family: georgia, palatino;font-size: 14px\">\u2022 Refunds for returned goods will be issued within 10 days of the date on which the Seller receives the returned items.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: georgia, palatino; font-size: 14px;\">The Seller reserves the right to refuse the return of goods if the Customer has failed to comply with the applicable return conditions, subject to applicable consumer protection laws.<\/span><\/p>\n<ul>\n<li class=\"translation-block\"><span style=\"font-family: georgia, palatino;font-size: 14px\">Where the Customer (Consumer) exercises their right to withdraw from the Sales Contract within 14 days (i.e. the right to return non-defective goods), the Customer shall be reimbursed for all payments made, including the purchase price of the goods and the standard delivery costs. However, in accordance with Article 6.228<sup>11<\/sup>, paragraph 3, of the Civil Code of the Republic of Lithuania, the Seller is not obliged to reimburse any additional delivery costs incurred where the Customer has expressly chosen a delivery method other than the least expensive standard delivery option offered by the Seller.
